Application of general terms and conditions

1.1 These general terms and conditions apply to all offers, reservation requests and agreements concluded with Casa Mavi and relate to villa 1 (10 persons) and villa 2 (6 persons) which are rented out by Casa Mavi.

1.2 Exceptions to these general terms and conditions are only possible if the parties have agreed in writing.

Reservation

2.1 Casa Mavi only processes reservation requests from persons aged 21 and older. Casa Mavi reserves the right to refuse a reservation request without stating reasons.

2.2 Reservations are possible via the website, by email or by telephone.

2.3 The agreement between Casa Mavi and the tenant is concluded when Casa Mavi has sent the reservation confirmation - also the invoice - to you by e-mail, on the understanding that you will receive the confirmation within 10 days.

2.4 The tenant must check the reservation confirmation for accuracy. Inaccuracies must be reported to Casa Mavi immediately. If you are not in possession of a written confirmation/invoice within 10 days after making the reservation, you must contact us immediately, otherwise no claim can be made on the reservation.

2.5 The tenant will make a (partial) payment to Casa Mavi within the period stated in the reservation confirmation. Casa Mavi is entitled to regard the agreement as not having been concluded if Casa Mavi does not receive the agreed (partial) payment within 14 days. In that case, Casa Mavi has the option to release the reserved accommodation to others without further notice to the tenant and to charge the tenant costs for cancellation.

2.6 The agreement concerns the rental of villa 1 or villa 1 and 2, which by its nature is short-term.

Changes to the reservation/agreement.

3.1 Casa Mavi is not obliged to make changes to the agreement at the tenant's request after the conclusion of the agreement. If Casa Mavi makes a change, Casa Mavi has the right to charge the tenant change costs, which amount to at least €10.00 per change.

3.2 In the event of changes that imply partial (e.g. shortening the reserved period or earlier departure) or complete cancellation, the cancellation conditions apply.

Prices

4.1 The tenant owes Casa Mavi the agreed rental price, as stated on the final reservation confirmation.

4.2 The prices are on the Casa Mavi website.

4.3 Unforeseen, demonstrable price increases can be passed on to the tenant. All prices in the price list, brochures and websites are subject to change and are subject to change.

4.4 Any discount promotions do not apply to existing/already made bookings.

4.5 Electricity: 200 kW per week is included in the rent. Additional consumption must be paid for on departure (or deducted from the deposit) at € 0.30 per kW.

Deposit

You must pay a deposit for the villas. The deposit is stated on your confirmation. The deposit will be refunded to you within 14 working days after departure: - If the villa is left tidy and broom clean. – The inventory and accommodation are still complete and undamaged. – No nuisance has been caused to nearby residents. – If the damage to the villa or the missing inventory exceeds the deposit paid, this must be paid before departure.

Payment

6.1 The tenant must pay a deposit of 30% of the entire amount according to the reservation confirmation/invoice within 14 days after reservation. The remainder 4 weeks before arrival.

6.2 If a reservation is made within 4 weeks before arrival, the entire amount must be paid immediately.

6.3 The tenant is not entitled to a (partial) refund of the rental amount if the tenant leaves before the agreed departure date.

6.4 Casa Mavi has the right to cancel the reservation and to release the villa for rental to others without further notice to the tenant, if a payment term has expired and the tenant has not fulfilled his obligations.

6.5 Casa Mavi has the right to terminate the agreement without notice of default or court intervention being required, on the understanding that the tenant is liable for all damage that Casa Mavi may suffer as a result, if: - at the start of the rental period the rental sum has not been paid (partially), default will then occur immediately; – tenant leaves the villa prematurely; – the tenant fails to occupy the rented property on the day of commencement outside the agreed arrival time, without informing Casa Mavi that the rented villa will be occupied later during the rental period.

6.6 Casa Mavi always has the right to offset claims against the tenant for whatever reason against the amounts paid by the tenant for whatever reason.

Changeover days/stay

7.1 The rented villa can be occupied from 4:00 PM to 8:00 PM and must be left broom clean upon departure before 11:00 AM.

7.2 Casa Mavi reserves the right to carry out a final inspection on the departure date from 9:00 am in connection with the condition and completeness of the villa. Casa Mavi reserves the right to charge for any damage.

(household) regulations

8.1 Guests must adhere to the rules established by Casa Mavi, as set out in the internal regulations. Casa Mavi has the right to immediately remove the tenant and his travel companions from the villa if the housekeeping rules are violated and/or instructions from key management are not followed. In that case, the tenant is not entitled to a refund of (part of) the rental amount.

8.2 Casa Mavi reserves the right to request the tenant to provide valid identification upon check-in. Casa Mavi is entitled to refuse access to the villa to tenants who cannot identify themselves.

8.3 Casa Mavi reserves the right to make changes to the facilities of the villa. The tenant will allow necessary maintenance to be carried out on the rented property during the rental period. The tenant cannot claim compensation. The need for maintenance is at the discretion of Casa Mavi. The tenant will also allow work to be carried out on the villa facilities during the stay if necessary.

8.4 The tenant will only use the villa as a holiday home.

8.5 The tenant must grant key managers of Casa Mavi direct access to the villa at all times.

8.6 The tenant may not rent and/or use the rented villa, nor allow more people to spend the night there than stated in the reservation and stated on the reservation confirmation. Casa Mavi has the right to terminate the agreement immediately and without court intervention if it finds that the agreed number of people in the villa has been exceeded.

Pets

9.1 After consultation and required approval, you are allowed to bring your pet into the villa.

9.2 Pets may not cause nuisance to local residents and when walking, the dog's needs must be cleaned up and thrown away in a poop bag.

Force majeur

10 Force majeure on the part of Casa Mavi exists if the execution of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond the control of Casa Mavi, including in any case blockages, fire and other disruptions and/or events. In that case, the tenant will never be able to sue Casa Mavi.

Liability

11.1 Casa Mavi accepts no liability for theft and loss of or damage to property or persons, of any nature whatsoever, during or as a result of a stay in our villa.

11.2 Casa Mavi accepts no liability for the fact that the stay in the villa does not meet the tenant's expectations.

11.3 Casa Mavi accepts no liability for damage or injury to property or persons as a result of a stay on the grounds of Casa Mavi or caused by the use of the facilities available on the site.

11.4 Casa Mavi is not liable for damage claims arising from noise pollution caused by third parties.

11.5 Casa Mavi is not liable for damage resulting from information provided verbally or by telephone from its key managers.

11.6 The design/layout of the villas may differ.

Complaints

12.1 Despite Casa Mavi's care and efforts, you may have a complaint. Complaints must be reported immediately to the key managers.

12.2 Spanish law applies to all agreements between the tenant and Casa Mavi.

General Obvious printing errors do not bind Casa Mavi. Where these conditions refer to accommodation, this refers to accommodation in 1 of the villas.
